Why Buy Investment Properties in an LLC?

Savvy real estate investors rarely hold properties in their personal names. Forming a Limited Liability Company (LLC) is the industry standard for asset protection.

If a tenant sues you over an injury on the property, holding the asset in an LLC generally confines the legal exposure to that specific entity. Your personal home, savings accounts, and other investments are protected from the lawsuit.

However, traditional banks and Fannie Mae/Freddie Mac conventional loans typically refuse to lend directly to an LLC. They require you to close in your personal name, forcing investors into a dangerous workaround of closing personally and quit-claiming the deed to an LLC later—which can trigger a "Due on Sale" clause.

The Solution: Non-QM and DSCR LLC Loans

To safely finance properties inside an entity, investors turn to business-purpose lenders providing DSCR (Debt Service Coverage Ratio) and portfolio loans.

These lenders prefer or even require that you close in the name of an LLC or Corporation. Because these are strictly business loans for investment purposes, avoiding personal-name closing helps ensure the transaction falls outside heavy consumer mortgage regulations.

With an LLC investment loan, the deed and the mortgage are both recorded in the name of the entity from day one.

Do I Need a Personal Guarantee?

Yes. This is the most common misconception about LLC loans.

While the loan is made to the LLC, almost all lenders require the majority members of the LLC to sign a Personal Guarantee (PG). This means that if the LLC defaults on the loan and the foreclosure sale doesn't cover the debt, the lender can pursue your personal assets for the difference.

Non-recourse loans (no personal guarantee) exist, but they are generally reserved for massive commercial properties or portfolios, requiring very low leverage (50-60% LTV) and institutional borrower profiles.
